Driving on a Suspended License
PENALTIES FOR DRIVING ON A SUSPENDED LICENSE
There are two main categories for driving on a suspended license. They are 1) driving after DMV suspension before DUI conviction, OR 2) driving after DMV suspension after DUI conviction. If your are driving on a restricted driver’s license, within the grounds of your restriction, then the following will not apply.
DRIVING ON SUSPENDED LICENSE BEFORE CONVICTION
VC 14601.5 prohibits you from driving on a suspended license. The penalty before DUI conviction is no mandatory jail, (although Ventura usually wants 5 days jail). A second offense before DUI conviction is mandatory 10 days jail. A third offense before DUI conviction is mandatory 30 days jail.
DRIVING ON SUSPENDED LICENSE AFTER CONVICTION
VC 14601.2 prohibits you from driving on a suspended license after DUI conviction. The penalty for driving with a suspended license after DUI conviction is 10 days mandatory jail. A second offense for driving with a suspended license after DUI conviction is mandatory 30 days jail.
NOTE: In either case your vehicle will be impounded and it is very difficult to get it back and very costly.
