Dos & Don’ts When Pulled Over for DUI in LA

The following are some do have and don’ts to remember when pulled over by law enforcement for suspected DUI in California:

Do:

  • Pull over and come to a complete stop on the left shoulder.
  • Turn off your motor vehicle.
  • Provide law enforcement with your driver’s license, a copy of your registration and insurance information.
  • Ask to speak to a lawyer.
  • Refuse to take a field sobriety test.
  • Refuse to submit to a PBT (Preliminary Breath Test).
  • Politely refuse to answer any questions (remember the officer will be looking for signs that you are intoxicated: the smell of alcohol, slurred speech, etc.).
  • Ask to take an independent breathalyzer & BAC test.

Don’t:

  • Antagonize the law enforcement officer.
  • Attempt to negotiate or bribe law enforcement.
  • Admit to guilt.
  • Discuss how much you have had to drink, or when.
  • Sign any documents except for the DMV Hearing/DUI ticket.
