Los Angeles DUI Attorneys
FAQ (Frequently Asked Questions) – Los Angeles DUI
If I’m facing DUI charges, how can a defense lawyer protect me?
A Los Angeles DUI lawyer can protect a person charged with DUI (driving under the influence) by asserting their legal rights and working to ensure that they are not violated. A lawyer can also challenge evidence and witness testimony brought against the defendant, argue the case in court and also negotiate with the prosecuting attorney before trial in order to have charges lessened, evidence excluded or possibly charges dropped altogether.
Do I have to schedule a DMV Hearing?
If you want to fight to keep your driving privileges following a DUI arrest, it is critical to schedule a DMV hearing. You must do this within 10 days of the date of your arrest. If you do not request a DMV hearing, your driver’s license will be automatically suspended for several months to over a year.
Can I lose my driver’s license if I am charged with a 1st offense DUI?
Yes. Your driver’s license will be suspended if you are convicted of a first DUI offense. However, under certain circumstances a person convicted as a first time offender may qualify for a hardship license in which they can drive to and from work, school or for medical purposes only.
What are the penalties for DUI in Los Angeles?
The penalties for a DUI conviction will vary depending upon the circumstances surrounding a case. However, typical penalties may include: imprisonment in county jail or state prison, large monetary fines, driver’s license suspension/revocation, victim restitution, community service, DUI School, alcohol/drug counseling, motor vehicle impoundment and the installation of an ignition interlock device. In addition, a person will receive a permanent mark on his or her criminal record and can receive a “strike” for felony DUI, which may result in enhanced penalties.
Do I have to agree to a blood test?
Yes. Under California’s “Implied Consent Law”, a person must agree to submit to a blood test or breath test to measure BAC (blood alcohol concentration) if they are suspected of drunk driving. While you can refuse a breath test or blood test, the failure to comply may result in an automatic license suspension.
